This Mobile Application/App (hereinafter referred to as the “Golf Been”), is a Golfing Community App providing a Social Media platform for Golfers to build a Community of their Golfing Friends and exchange communications regarding their Golfing experiences, memories, pictures etc.
Your access and use of the App and of our services and tools are subject to the Terms and Conditions contained in this document (hereinafter referred to as the “Terms of Use”) including any of the applicable policies which are incorporated herein by way of reference.
If you access and/or use and/or transact on the App, you shall be subject to the Terms and Conditions and Policies of use of the App.
By mere use of the App, you shall be contracting with Golf Been and these Terms of Use including the policies (Privacy Policy) constitute your binding obligations, with Golf Been.
The Terms of Use shall be deemed to have been accepted by you whenever you access, browse, or otherwise use the App or avail any of our services or offers. By accessing, browsing, or using the App or any of our services or offers, you agree that you have read, understood, and are bound by the Terms of Use. You are requested not to use the App or avail any of our services or offers, if any of the terms and conditions contained in these Terms of Use is unacceptable to you or if you do not wish to be bound by these Terms of Use.
In these Terms of Use, references to "You", “Your”, "User" shall mean the User visiting the App and/or accessing and using our services or tools or Golf Been App, and "We", "Us" and "Our" shall mean Golf Been.
DESCRIPTION OF SERVICES AND GOLF BEEN
Golf Been is as an App for the Golfing Community which aims at providing a Social Media platform for Golfers to build a Community of their Golfing Friends and exchange communications regarding their Golfing experiences.
The Golf Been App service provides an easy and convenient means to record and keep track of Courses Played-in, memories, pictures, ratings etc.
Through the App, Golfers can invite their Buddies to be part of their Golfing Group, share and exchange experiences.
Golfers using the App can, using the Posts / Chat feature share current Course they are playing in our schedule Golf games using the Tee Post feature.
On selecting a Golf course that a user has played-in, the course is flagged on his Golf Been Map to show all the courses he has played in at a Glance.
Users can, learn more about courses that their friends may have played in by clicking on the url of the Golf Course and can contact the particular Golf course for further enquires or making a booking etc.
CONSENT AND AGE OF USER
While this website is open for all ages however, for persons younger than 18 years old, the use of any of our services and website is only allowed with the valid consent of a parent or a guardian. Where any person younger than 18 years old uses or gains access to the Mobile Application, it shall be deemed that the said User is doing so with the valid consent of a parent or a guardian, the responsibility to seek a valid consent from a guardian or parent shall lie upon such User and Golf Been disclaims all liability and indemnifies itself from any liability or loss arising from the data/information provided in such an event and the User shall indemnify Golf Been for the same. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without their consent, he or she should contact the Grievance Officer at grivenanceofficer@GolfBeen.com in case they wish to cease the usage of the Profile.
USE OF GOLF BEEN AND THE SERVICES PROVIDED THEREIN
Creation of Account/Supplying related information:
- For the use of this Mobile App thereon, the Users shall register on the App using the User’s Email ID. The Users shall be liable for the information supplied by them during this process.
- Golf Been shall not be responsible for any loss of opportunity or profits arising from the negligence of failure of the User.
- Golf Been specifically states that the Mobile Application can only be used by registered Users of the App and the App cannot be accessed by Non-registered Users.
- The User may at any time place request for removal or deletion their User account from Golf Been. In case the User wishes to remove or delete their Golf Been account, the User shall send a mail from his registered email to help@GolfBeen.com placing a request for removal of her/his account. After then, the admin shall remove that account and the User shall generate such request at their own risk and responsibility as an account once deleted cannot be retrieved back and all the data stored up until that point shall be lost to the User.
All details provided on Golf Been including but not limited to reviews, photos, your profile and comments are all subject to the Terms of Use and Privacy Policy and at the discretion of the management of Golf Been.
The App may permit the Golf Courses and equipment suppliers to offer/promote their products on Golf Been and the Users may interact or contact the organizer/owner of the Golf Course or Golf Equipment Suppliers or visit the offers/promotions page to find out more about the terms and conditions applicable to their offer.
By using the Golf Been App and availing the offers/Promotions, the User accepts and understands that Golf Been is not liable for any claim for non-acceptance/misuse of the offer. The Users should contact promoter for the appropriate resolution,
USER COMMUNICATIONS
Users are prohibited from posting or transmitting any defamatory, obscene, pornographic, profane, threatening, objectionable, seditious, or unlawful material or any content that could constitute or encourage conduct that would be considered a criminal offense or harm minors, contain software virus, give rise to civil liability, or otherwise violate any law.
Golf Been may but is not obligated to, monitor, or review such content and shall take necessary action as deemed fit.
By Posting any content the User warrants and represents that the User owns or otherwise controls all the rights to their content including, without limitation, all the rights necessary for the User to provide, post, upload, input or submit the content. User further represents that the information/content they submit is not confidential.
The App enables an user to Block and Report objectionable content.
Golf Been expressly disclaims any liability arising from or related to the content of any such content posted or supplied by User, whether arising under the laws of intellectual property, libel, privacy, obscenity, or otherwise under laws applicable to it.
Golf Been is committed to cooperate with any law enforcement authorities or court order requesting or directing it to disclose the identity of anyone posting such content.
NO WARRANTIES; EXCLUSION OF LIABILITY; INDEMNIFICATION
When a Golf course or Golf Equipment Supplier promotes his product on this App, it is to be clearly understood that Golf Been is providing a service between Users and organizer/owner of the Golf Courses or Golf Equipment Supplier and has no control or right over specific organizer/owner of the Golf Course policies or offer and promotions.
The User understands and undertakes to abide by all the rules and regulations as laid down by the Gold Course Owner or Organizer.
The Mobile Application, and content thereon is operated by Golf Been on an "as is," "as available" basis, without representations or warranties of any kind.
The Users warrant and represent that any information, content, or materials communicated to or shared through/with Golf Been does not violate any third party’s rights or is not contravention of the law.
The User agrees to defend, indemnify, and hold Golf Been harmless from and against all claims, damages, costs and expenses, including advocate’s fees, arising from or related to their use of Golf Been App or any services/offers/promotions they purchase through it.
USE OF PERSONAL INFORMATION
We at Golf Been are committed to protecting and ensuring all necessary precautions are taken while handling and storing your personal details. Only authorized employees in the company have access to User’s details and information & are prohibited from using this information for any personal or commercial use. Our use of your personal information is governed by our Privacy Policy.
All personal details related to customers, clients are deemed confidential and all necessary precautions are taken to maintain them in a secure environment and that the details are not divulged to any third party, other than to appropriate authorities, only in case if it is a legal requirement. Golf Been will not sell, share, or rent your personal information to any third party without your consent.
Golf Been will engage with Users through emails, messages only in connection with the provision of agreed services and products.
COMMUNICATIONS/NOTIFICATIONS
Golf Been will intimate its registered Users about regular updates, offers, promotions, and new additions to its platform via prompt notification and flash messages upon using Golf Been.
INTELLECTUAL PROPERTY RIGHTS
The Mobile Application/App, its features and functionalities, materials and content, and the mark Golf Been’ as well as other brand names featured on the Golf Been are owned by and proprietary to Golf Been. Any use, reproduction, or redistribution of such materials not in accordance with these Terms of Use is prohibited.
Any distribution, modification, hosting, transmission, publication or use of the content, including text, images, audio, and video, for any personal, business, commercial or public purpose without prior permission is subject to legal action.
The User is prohibited to display, host, upload, modify, publish transmit, update or share any content available on the Mobile Application/App without prior permission except for the content belonging to the User
Subject to the conditions stipulated herein, Golf Been hereby grants the User a non-exclusive, revocable, limited, non-sub-licensable and a non-transferable license to use and have access to the, App for personal and non-commercial purposes.
The Users agree not to interrupt or try to harm the operation of Golf Been in any way.
Golf Been accepts all personal details provided in good faith as being truthful and accurate and therefore, is not obligated to verify any User information.
DISPUTE RESOLUTION AND REDRESSAL MECHANISM
Any complaints, abuse or concerns with regards to content and or comment or breach of these terms shall be immediately informed to the designated Grievance Officer as mentioned below in writing or through email signed with the electronic signature at grievanceofficer@golfbeen.com.
GOVERNING LAW AND JURISDICTION
The use of this Mobile Application and the services provided by Golf Been as well as the Terms of use shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Courts at New Delhi.
The Mobile Application Golf Been is owned by FiberX Technologies LLP (hereinafter referred to as FTL), a Company incorporated under the laws of India with its registered office at 84, Deerwood Chase, Nirvana Country, Gurgaon, India,122018.
All the terms and conditions form part of the Terms of Use between the User and Golf Been and are legally binding. Accessing this Mobile Application/App and/or using it indicates your understanding, agreement to and acceptance, of the Terms of Use contained herein.
